In order to use our free RaboPlus Widget ("the Widget"), you must agree to the following terms and conditions. By clicking "Get It - Download the widget", you acknowledge and agree to be bound by the terms and conditions of this Agreement between you and Rabobank Australia Limited, the issuer of RaboPlus ("RaboPlus"). If for any reason you do not agree to be bound by each and every term of this Agreement, you should cancel this screen to exit the process.
Subject to the terms and conditions of this Agreement and except as otherwise expressly set forth herein, RaboPlus grants you a worldwide, non-exclusive, non-transferable right and license to download, access, and use the Widget solely for your personal use.
You must not sublicense, copy, reproduce, modify, vary, disassemble, decompile or reverse engineer the Widget.
The Widget is made available by RaboPlus on an "as is" and "as available" basis and RaboPlus gives no warranty of any kind in relation to the Widget, any third party software or services used in providing the Widget or content thereon including but not limited to implied warranties of satisfactory quality, compatibility, and accuracy regarding the Widget and any content thereon.
YOU UNDERSTAND AND AGREE THAT YOU USE THE WIDGET AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY BUSINESS INTERRUPTION OR DAMAGES TO COMPUTER SYSTEMS OR LOSS OF INFORMATION OR DATA THAT RESULTS FROM YOUR USE OF THE WIDGET.
ALL INFORMATION DISPLAYED ON OR THROUGH THE WIDGET IS SUBJECT TO THE RABOPLUS WEBSITE DISCLAIMER.
RaboPlus excludes all liability to you for any loss or damage (including without limitation any indirect, incidental, consequential, special, exemplary, and punitive damages) howsoever arising out of or in connection with this Agreement, including but not limited to any liability arising in relation to the Widget, any virus or other contamination. This limitation of liability shall apply whether the damages arise from use or misuse of and reliance on the Widget or any content thereon, from any inability to use the Widget, or from the interruption, suspension, or termination of the Widget (including such damages incurred by third parties).
You hereby agree to indemnify, hold harmless and defend RaboPlus in respect of all images, costs and expenses, including reasonable legal fees and litigation expenses, arising out of or as a result of any breach of this Agreement or otherwise in connection with your use of the Widget or content thereon.
You may terminate this Agreement at any time by destroying or removing all copies of the Widget from your hard drives, networks and other storage media. RaboPlus may restrict, suspend or terminate this Agreement, or your use or access to the Widget at any time without liability.
This Agreement shall be governed by, construed and take effect in accordance with the laws of New South Wales, Australia and the courts of New South Wales, Australia shall have exclusive jurisdiction to settle any claim or dispute which may arise out of or in connection with this Agreement.
